Thus, where at a civil case two individuals dispute their faith, a criminal prosecution entails the people as a whole deciding whether to punish someone because of his behavior or lack of conduct (i.e. omission). As the folks decide what behavior to punish, so that the folks decide what punishment is acceptable. Thus, punishments vary with the severity of the offense from a very simple fine (e.g. for a traffic violation) to lack of freedom. |
