| Power regulator leniency on procedural delays could reshape PPA risk in Himachal’s renewables ecosystem. In an order dated 13 October 2025, HPERC condoned a seven-
month delay (plus three days) by Swadeshi Distributors LLP in filing a review against the 26 December 2024 tariff ruling tied to an SPPA with HPSEBL. The Commission cited internal consultations and complexity, imposed a token Rs 2,500 cost, and listed the matter for 18 November 2025—a signal that the Power regulator is prioritising substantive fairness over rigid timelines.
This stance may echo across future contracts: developers and lenders depend on fixed SCOD and tariff applicability dates to lock financial closure. If a Power regulator repeatedly condones late filings—especially where both utility and generator claim “mutual grievance”—procedural discipline weakens, pushing pricing uncertainty into models for small hydro and solar. It also exposes coordination gaps within utilities. |
